These Terms of Service ("Terms") govern your access to and use of software applications and websites operated by BMSVT Enterprises LLC ("we," "us," or "our"), including NutritionTracker Pro. By using our services, you agree to these Terms.
1. Use of Services
You must be at least 18 years of age to use our services. By using our services, you represent that you meet this requirement and that you will use the services only for lawful purposes and in accordance with these Terms.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.
3. Subscriptions and Payments
- Certain features require a paid subscription, billed monthly or annually.
- Subscriptions include a free trial period as stated at signup. You will not be charged during the trial.
- Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method.
- Subscriptions automatically renew at the end of each billing period unless cancelled.
- You may cancel your subscription at any time through your account settings or the customer portal.
- Refunds are handled on a case-by-case basis.
4. User Content
You retain ownership of content you enter into our applications (food logs, notes, etc.). By using our services, you grant us a limited license to store and process your content solely to provide the services to you. We do not use your personal health data for advertising or sell it to third parties.
5. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Interfere with or disrupt the integrity or performance of our services.
- Reverse engineer or attempt to extract source code from our applications.
6. Health Disclaimer
Our applications provide general nutrition and fitness tracking tools and AI-generated suggestions for informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making significant changes to your diet or exercise routine.
7. Intellectual Property
All content, features, and functionality of our applications — including text, graphics, logos, and software — are owned by or licensed to BMSVT Enterprises LLC and are protected by applicable intellectual property laws. You may not copy, modify, or distribute our content without written permission.
8. Limitation of Liability
To the maximum extent permitted by law, BMSVT Enterprises LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Termination
We may suspend or terminate your access to our services at any time for violation of these Terms or for any other reason, with or without notice. You may terminate your account at any time through account settings.
10. Governing Law
These Terms are governed by the laws of the State of Vermont, United States, without regard to its conflict of law provisions.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of our services after changes constitutes acceptance of the updated Terms.
